Filmster Network (“we”, “our”, “us”) is committed to protecting the privacy, rights, and wellbeing of children and minors (individuals under the age of 18) who interact with the Services, whether as platform users, subjects in creative projects, or collaborators. This Children’s Privacy and Minor Protection policy (“Policy”) defines our safeguards, consent requirements, data handling standards, and responsibilities for filmmakers and users when minors are involved.
This Policy applies in addition to and alongside our Privacy, Terms of Service, Community Guidelines, and all other applicable platform policies. Where a conflict arises, the more protective standard will prevail in favour of safeguarding minors.
1. Scope and Definitions
“Minor” or “Child” refers to any natural person under the age of 18.
“User Accounts involving Minors” means accounts registered or used on behalf of minors by a parent or legal guardian.
“Project Content involving Minors” refers to any media, including photos, videos, documentation, or other creative assets that depict or involve minors within collaboration projects on the platform.
2. Platform Registration and Use
2.1 Prohibition on Direct Minor Registration
Filmster Network is primarily intended for users aged **18 and over**. Individuals under the age of 18 **must not** register for a direct account or use the platform independently.
2.2 Parent / Guardian Accounts
Parents, legal guardians, or licensed representatives may create and manage accounts on behalf of minors for legitimate, supervised project involvement or representation. In such cases:
- The parent or guardian must provide valid identification and consent documentation upon request.
- The account holder assumes full responsibility for all activities and data associated with the minor’s use.
2.3 Verification
We reserve the right to request verification of age or guardianship at any time to ensure compliance with this Policy.
3. Data Collection and Processing of Minors
3.1 Lawful Basis for Processing
We will only collect, store, or process personal data related to minors where:
- Explicit, verifiable **consent** is provided by a parent or legal guardian; and
- Such processing is necessary to enable the Services (e.g., project participation) and cannot reasonably be achieved through anonymised or proxy data.
Examples of data may include:
- Media files (photos, video, audio) where minors appear within projects.
- Project metadata (scene details, narrative elements) involving minor subjects.
- Contact information of parent or guardian managing the minor’s involvement.
3.2 Sensitive Data
We do not collect sensitive personal data (such as health information, legal identifiers, or protected characteristics) of minors unless strictly required and accompanied by explicit consent for a specific purpose.
3.3 Purpose Limitation
Data relating to minors will only be processed for purposes directly connected to the participation or representation within the Services and not used for unrelated profiling or marketing.
4. Parental / Guardian Consent
4.1 Clear and Verifiable Consent
Before any data of a minor is collected, processed, stored, or shared on the platform:
- A parent or legal guardian must provide informed, clear, and verifiable consent.
- Consent must be documented and stored in compliance with applicable data protection regulations.
4.2 Scope of Consent
Consent must specify the purpose (e.g., inclusion in a collaborative project, public display within project context) and the scope of sharing within the Filmster Network ecosystem. The parent or guardian may withdraw consent at any time, subject to confirmation in writing or through the platform interface.
4.3 Withdrawal of Consent
Upon withdrawal of consent:
- We will cease processing further data related to the minor for the specified purpose.
- Where feasible, we will delete or anonymise previously processed data unless retention is required by law or for structural obligations.
5. Project Content Involving Children
5.1 Responsible Filmmaking Practices
Users, including filmmakers and collaborators, must adhere to the highest ethical standards when including minors in creative content. This includes:
- Securing appropriate consent from a parent or legal guardian.
- Respecting location, context, and intent for all representations of minors.
- Avoiding exploitative, harmful, unsafe, or inappropriate depictions.
- Content that violates this requirement will be removed and may lead to account restrictions or termination.
5.2 Limited Access Settings
Creators may set access levels for projects involving minors, including:
- Private or invitation-only visibility.
- Time-limited sharing agreements.
- Explicit disclaimers where public display is intended.
Such configurations reinforce responsible dissemination consistent with parental consent.
6. Safety and Conduct
6.1 Anti-Exploitation Measures
We strictly prohibit any form of exploitation, abuse, or coercion of minors within projects or interactions. Any reported conduct suggesting exploitation will be investigated immediately and escalated to appropriate authorities where required.
6.2 Reporting Mechanisms
Users may report suspected violations, misuse of minor data, or exploitative content through the in-platform reporting tools or by contacting **[safety@filmster.network](mailto:safety@filmster.network)**. Each report will be reviewed in accordance with our safety and legal response protocols.
6.3 Mandatory Reporting
In jurisdictions where mandatory reporting of suspected child abuse or exploitation is required by law, we will comply with applicable obligations and may share information with law enforcement or child protection authorities without prior notice to the reporting party.
7. Data Retention and Deletion
7.1 Retention Principles
Personal data related to minors will be retained only for as long as necessary to fulfil the project purpose or as required by law. Retention periods will be evaluated based on project status, ongoing consent, and legal retention obligations.
7.2 Deletion Requests
Parents or guardians may request deletion of a minor’s personal data at any time via account settings or by contacting **[privacy@filmster.network](mailto:privacy@filmster.network)**. Requests will be processed in compliance with applicable data protection laws, including GDPR, UK GDPR, CCPA/CPRA, and India’s data protection framework.
8. International Obligations and Compatibility
This Policy is designed to align with global standards for the protection of children’s data and online safety, including but not limited to:
- EU General Data Protection Regulation (GDPR) provisions relating to minors;
- UK GDPR and Data Protection Act 2018;
- US best practices under the Children’s Online Privacy Protection Act (COPPA) where applicable;
- India’s Personal Data Protection Act (2023) requirements for consent and minor data protection.
Where local law provides greater protections for minors, the stricter standard will prevail.
9. Updates to This Policy
We may update this Policy as laws evolve, new risks are identified, or platform functionality changes. We will update the “Last updated” date accordingly and, where required, notify users of material changes. Continued use of the Services after changes indicates acceptance of the updated Policy.
